1. Acceptance of Terms

By accessing and using Qapture ("the Service"), you accept and agree to be bound by the terms and conditions of this agreement. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Qapture is a photo and video sharing platform that allows users to create albums, upload media content, and share them with others via QR codes and unique URLs. The Service is provided for personal and non-commercial use.

3. User Accounts and Registration

• You must be at least 13 years old to use this Service.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and complete information during registration.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.

4. Content Guidelines

By uploading content to Qapture, you agree that:

• You own the rights to the content or have permission to upload it.
• Your content does not violate any applicable laws or regulations.
• Your content does not contain viruses, malware, or harmful code.
• You will not upload content that is illegal, offensive, defamatory, obscene, or infringes on others' rights.
• You will not upload content containing hate speech, violence, or harassment.
• You grant Qapture a non-exclusive license to store, display, and share your content as necessary to provide the Service.

5. Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose or to violate any laws.
• Attempt to gain unauthorized access to the Service or other users' accounts.
• Upload excessive amounts of data or engage in activities that could harm the Service's infrastructure.
• Use automated tools (bots, scrapers) without express permission.
• Impersonate others or misrepresent your affiliation with any person or entity.
• Interfere with or disrupt the Service or servers connected to the Service.

6. Privacy and Data Protection

• Your use of the Service is also governed by our Privacy Policy.
• We collect and process personal data as described in our Privacy Policy.
• You are responsible for the privacy settings of your albums and the content you share.
• Public albums may be accessible to anyone with the link or QR code.

7. Intellectual Property Rights

• The Service, including its design, features, and functionality, is owned by Qapture and is protected by copyright and other intellectual property laws.
• You retain all rights to the content you upload.
• By uploading content, you grant Qapture a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content solely for the purpose of operating and improving the Service.

8. Content Removal and Account Termination

• We reserve the right to remove any content that violates these terms without prior notice.
• We may suspend or terminate your account for violations of these terms.
• You may delete your account at any time. Upon deletion, your content will be removed from our servers.
• We reserve the right to refuse service to anyone for any reason at any time.

9. Storage and Data Retention

• We strive to maintain the availability and integrity of your uploaded content.
• We are not responsible for any loss of data due to technical failures, security breaches, or other unforeseen circumstances.
• You are responsible for maintaining your own backups of important content.
• We may implement storage limits and may delete inactive accounts or content after a period of inactivity.

9.1 12-Month Storage Period

• Every album is stored for 12 months. When that period ends, the album and all photos and videos in it are permanently deleted.
• For a free album the period runs from the date the album was created. For a Premium album it runs from the date Premium was purchased for that album, so upgrading restarts it.
• What Premium buys is 12 months of storage for one album, together with the features listed at the point of purchase. It is a one-time payment, not a subscription, and it does not renew — no further payment is taken and the album is not kept beyond the 12 months.
• We will email the album owner before the deletion date (30, 15, 7 and 1 day beforehand for Premium albums; 7 and 1 day beforehand for free albums) so that content can be downloaded in time. Opting out of our emails stops these warnings but does not extend the storage period.
• Deletion is permanent and irreversible. We cannot restore an album, its media, or its share link once the period has ended.
• If a Premium purchase is refunded, the album's Premium features are withdrawn. Its storage period continues to run from the original purchase date and is not shortened by the refund.

10. Disclaimers and Limitations of Liability

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
• We do not guarantee that the Service will be uninterrupted, secure, or error-free.
• We are not responsible for content uploaded by users.
• To the maximum extent permitted by law, Qapture shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability shall not exceed the amount you paid us in the last 12 months (if applicable).

11. Indemnification

You agree to indemnify and hold Qapture harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these terms.

12. Third-Party Links and Services

• The Service may contain links to third-party websites or services.
• We are not responsible for the content or practices of third-party websites.
• Your use of third-party services is at your own risk.

13. Changes to Terms

• We reserve the right to modify these terms at any time.
• We will notify users of significant changes via email or through the Service.
• Continued use of the Service after changes constitutes acceptance of the new terms.

14. Governing Law and Dispute Resolution

• These terms shall be governed by and construed in accordance with applicable laws.
• Any disputes arising from these terms or the Service shall be resolved through binding arbitration or in courts of competent jurisdiction.

16. Severability

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Qapture regarding the use of the Service.
